Juvenile Offenses

Youth under the age of 18 who break the law are charged with a juvenile offense which initially is not considered a crime. The young man or woman will either be notified bya summons of their infraction or may actually be  arrested if caught in the commission of the crime. This means he or she is taken into custody by a police officer and transported to a detention facility. Police must then contact parents or guardians to inform them of their child’s situation.

While a young person is in custody the police may try to question them. If this happens you are only required to give your correct name and address. After that it is best to ask for a lawyer. This will prevent the police from continuing their interrogation until you have proper representation. While you may be innocent of all charges an attorney is trained to ensure your rights are protected under the law. Court appointed lawyers are available for those who cannot afford their own lawyers.

A summons delivered by a police officer informs the young adult and family of the charges against them as  well as the court date and location. If a person fails to show for court the judge will issue a bench warrant for your arrest. All juveniles charged with any type of offense are assigned to a probation officer who may suggest you meet certain conditions as a part of your rehabilitation outside the jurisdiction of the Courts.

Finally, serious juvenile crimes that involve weapons and/or violent acts may find their case is ‘bound over’ to adult court. The consequences are much greater in these circumstances so it is best to make good choices before finding yourself in ‘hot water’.
